1. THESE TERMS
1.1 What these terms cover: These terms and conditions explain how we supply artwork (goods, services, or digital content) to you.
1.2 Why you should read them: Please read them carefully before placing an order. If there is an error or omission in our terms, contact us before ordering.
2. INFORMATION ABOUT US AND HOW TO CONTACT US
2.1 Who we are: CIRCA Art Limited, registered in England & Wales (No. 07284783), with registered office at 13 Hague Street, London, E2 6HN. VAT No. 993110228 (“we”, “us”, “CIRCA”).
2.2 Contacting us: For customer support, email: customerservice@circa.art.
2.3 How we may contact you: We may write to you via the email or postal address or phone number provided.
2.4 Meaning of “writing”: References to “writing” include emails.
3. OUR CONTRACT WITH YOU
3.1 Order acceptance: Your order is an offer. The contract is formed when we email confirmation.
3.2 Your status: By ordering, you confirm you are at least 18, have legal capacity, and have provided accurate information. You must not copy or resell purchased artworks without permission.
3.3 If we cannot accept your order: If we cannot accept your order (for example due to stock, pricing errors, or delivery issues) we will notify you and no charge is made.
3.4 Order number: We’ll assign and communicate an order number upon acceptance. Quote this number in all correspondence.
4. PRODUCTS
4.1 Variations: Product images and packaging are illustrative. Colours and details may vary slightly in reality.
4.2 Sustainability: Packaging may vary; we aim for sustainable practices whenever possible.
5. YOUR RIGHTS TO CHANGE OR CANCEL

6. OUR RIGHT TO CHANGE THESE TERMS OR THE PRODUCTS
6.1 Minor changes: We may make minor corrections or improvements (e.g. typographical, technical updates).
6.2 Significant changes: If significant changes to the product or terms are necessary, we will notify you before they take effect. You may then cancel the contract with a full refund.
7. DELIVERY
7.1 Delivery costs: Will be shown at checkout.
7.2 Delivery timing: We will inform you of estimated delivery dates during checkout. Delivery times may vary.
7.3 Delays outside our control: We are not liable for delays beyond our reasonable control (e.g. weather, customs). If a delay is significant, you may cancel and receive a refund for undelivered items.
7.4 Failed delivery: If delivery fails and you do not arrange re‑delivery or collection, we may charge for storage or shipping.
7.5 Ownership and risk: Risk transfers when artwork reaches your address or is collected. You own the item once payment is received in full.
8. YOUR RIGHTS TO END THE CONTRACT
8.1 Ending due to fault or misdescription: You may reject faulty or misdescribed artwork and claim a refund or replacement.
8.2 Ending due to our error or delay: If we notify of a pricing error, delay over one month, or suspension of supply, you may cancel with a full refund.
8.3 Change of mind: Under UK Consumer Contracts Regulations, most non-custom made goods can be cancelled within 14 days of receipt. This right does not apply to bespoke artwork or digital content once commenced. Return costs may apply.

9. OUR RIGHTS TO TERMINATE
We reserve the right to end the contract if:
- Payment is overdue and remains unpaid after 2 days notice.
- Required info (e.g. delivery address) is not provided.
- Delivery is refused or collection not arranged.
- You misuse or resell our products without permission.
If we terminate, we’ll refund for undelivered products but may deduct for our losses.
11. LIABILITY
11.1 Foreseeable loss: We accept liability for foreseeable losses incurred from our breach, provided they were known or obvious.
11.2 Unlawful exclusions: We do not limit liability for death, personal injury, fraud or violation of your statutory rights (e.g. defective goods).
11.3 Business use: We are not liable for business-related losses (e.g. lost profits or business interruption).

13. OTHER LEGAL CONDITIONS
13.1 Transfer: We may transfer our rights or obligations to another company.
13.2 Third-party rights: Only you and us can enforce these terms; no third-party involvement.
13.3 Severability: If a term is unenforceable, the rest remains valid.
13.4 No waiver: Failure to enforce rights immediately doesn’t waive them later.
13.5 Governing law and jurisdiction: These terms are governed by English law. Disputes will be resolved in the courts of England & Wales.
13.6 Dispute resolution: If unresolved after internal review, you may approach an ADR (Alternative Dispute Resolution) provider. Approved UK ADR bodies are listed at Trading Standards.
